SmartNet Ltd. (hereinafter, “SmartNet”) thanks you for accessing the Site. Since the
usage conditions at the Site may sometimes change, we recommend re-examining them from
time to time.
These usage conditions apply to you, whether or not you have decided to choose SmartNet’s
services.
The conditions are drafted in the masculine form for convenience only, but obviously
they are also intended for women.
Any content or information that is included in the Site or any other service of any type
whatsoever is not to be used or [sic] for any purpose that is not private and personal
without the prior written consent of SmartNet.
In any event, you must refrain from removing, deleting or interfering with any notice
or sign regarding intellectual property rights that accompanies the designs and information
at the Site.
All of the creators’ rights and intellectual property rights at the Site, in the trademarks
thereat, the Site’s design, the designs that are publicized on it, and in any software,
application, computer code, graphic file, voice file, video file, text and any other material that
is included therein – belong solely to SmartNet, or to a third party that allowed SmartNet to use them.
You may not copy, distribute, exhibit publicly, change, process, create derivative creations,
sell or lease any part of the foregoing, whether by you or through a third party, while using
electronic or mechanical means, through photography or recording or in any other way, without
the prior written consent of SmartNet or of the other rights’ holders as the case may be.
The use of the Site and the designs is given as is, and there may be no complaint, claim or
demand against SmartNet for the characteristics of the use, the limitations or the reactions
caused by advertising at the Site. The use of the designs presented at the Site is made subject
to your full and exclusive liability.
SmartNet is entitled to close the Site and to change its structure, appearance and the availability
of the services and designs that it gives from time to time, without the need for any prior notice.
You shall have no complaint, claim or demand against SmartNet in connection therewith.
SmartNet makes no undertaking that the service given to you at the Site will not be interrupted,
nor that it will be given in an orderly manner without stoppages or
interruptions nor that it will be immune from illegal access to SmartNet computers, nor from damages,
failures, malfunctions, or failures in SmartNet’s hardware, software, or communications lines, or those
of any of its suppliers, or from damage for any other reason, and SmartNet shall not be liable for any
direct or indirect damage, pain and suffering or similar things that are caused to you or to your
property as a result thereof.
To the extent possible, SmartNet will refrain from giving your personal details to third parties unless
it is required to do so by a judicial order or if it stands before a threat that legal action will be taken
against it (criminal or civil) for actions that you took at the Site. In that event, SmartNet is entitled to
deliver your details to the party that claims that it was damaged by you, or [to act] pursuant to the judicial
order’s instructions.
SmartNet is entitled to use your details to improve the services that it offers you at the Site, and to communicate
with you and to make the Site appropriate for your needs and personal preferences. SmartNet shall not transfer to
any third party whatsoever information that may personally identify you unless you wish it to do so.
SmartNet does not undertake that all of the links found at the Site will work and will lead to an active internet site;
the presence of a link to a specific site at the Site does not prove that the content of the linked site is reliable,
full or current, and SmartNet shall bear no liability in connection therewith. Without derogating from the foregoing,
SmartNet is not liable for any direct or indirect damage that is caused to you or to your property as a result of
use or reliance on the information and designs that appear in the sites that you reach by means of or through existing
use or links on the Site and/or for use or reliance on information and designs that are published on the Site by third parties.
If you choose to engage SmartNet’s services, in addition and especially, and without derogating from these usage conditions,
the usage conditions for hot points will apply to you.
The laws of the State of Israel shall apply exclusively to these usage conditions and to the usage conditions for hot points.
In any matter that derives from and/or is connected with the foregoing usage conditions and/or with the usage conditions of
the hot points, the exclusive jurisdiction shall be given to the competent court in the Tel Aviv, Israel district.
