Welcome to the Wireless Internet Broadband Connection with WLAN technology
(hereinafter - "The Service") provided by SmartNet Inc. (hereinafter
-"SmartNet").
Before you enter The Service, or use any SmartNet

- "Terms"). By using The Service,
you accept these Terms and agree to be legally bound and subject to them. If you
do not agree to the Terms please exit The Service immediately.

actual notice to you. In addition, SmartNet, at its sole discretion, may change or
cancel The Service or any part thereof, and without any actual notice to you.

warranties and liability, express or implied, concerning the use of The Service.

stated otherwise. The copyright of the material contained in The Service and any
of SmartNet trade marks, service marks, trade names, service names, logos
(in each case whether or not registered) and any other intellectual property rights
included in The Service and/or in the information contained thereon belong only
to SmartNet. SmartNet grants its users a nonexclusive and non transferable
license to use The Service for personal purposes only. Any copy of information
which constitutes part of The Service shall include notices of the intellectual
property rights in the information.
Limitation of liability
- SmartNet assumes no responsibility, and shall not be liable for any kind of damages
to you and/or any third party related to you or anyone on your behalf in connection with
your use of The Service including damages that may occur to your computer and/or
any equipment thereon, including damages arising out of your use of any internet site
or other material via links from the site or from downloading files from the internet.
- Without derogating from the aforementioned, it is hereby made clear that the access line to
the internet and the modem itself, through which the navigating in the net by The Service is
possible, are not provided by SmartNet and are not under the responsibility of SmartNet
or whoever on its behalf. SmartNet assumes no responsibility, and shall not be liable for
any kind of damages to you and/or any third party related to you on account of errors,
failures, omissions, or other inaccuracies in the access line to the internet and the modem.
- SmartNet is not responsible, and will not bear any liability, to The Service user and/or any third
party in connection with the contents advertised on the internet which may offend in some respect
the user and/or anyone on his behalf and/or any third party and which contents may constitute
a violation of any law and/or regulation.
- SmartNet is not liable, and will not be liable, to The Service user and/or any third party, for loss of
information and/or presentation of information and/or disclosure of information of the user and/or
any third party, arising in any way out of the use of service.
For the purpose of this chapter, SmartNet shall be construed so as to include its workers
and representatives.
Declarations and obligations of the user
- While using The Service you depose and undertake as follow:
9.1. Not to do any act which will be in violation of the Terms and to follow the Terms
in full.
9.2. Any personal information provided by you while using The Service shall be
true,accurate, current and complete.
9.3. Not to impersonate any other person or entity or falsely state or otherwise
misrepresent your affiliation with any other person or entity; forge
headers or
otherwise manipulate identifiers in order to disguise the originof any material
transmitted while using The Service and/or through the processof registration
to The Service and you will not do any act thatis not allowed or authorized.
9.4. Not to do any
act in violation of any applicable local, state, national or
international laws, rules or regulations.
9.5. Not to present and/or add to The Service and/or any other internet site
information and/or contents and/or links that are unlawful and/or might be
threatening, abusive,harassing to the public and/or might be tortuous,
defamatory, obscene, libelous, invasive of another's privacy and/or might
encourage or abet the commission of an act that constitutes a felony or
misdemeanor.
9.6. Not to edit
and/or transmit to The Service and/or via The Service, a linkage to
any computer software any material (by uploading, email, posting, or otherwise)
that contains software viruses or any other computer code, files or programs
whatsoever designated to interrupt, destroy or limit the functionality of any
computer software or hardware or telecommunications equipment.
9.7. Not to use computer programs, computer files, internet sites and other
services that require payment of fee, without paying the required fee, through
The Service.
9.8. That SmartNet will not be liable for any direct, indirect, or consequential loss to
you or any one on your behalf or any third party rising from the use of The
Service.
9.9. That the use of The Service including any reliance on The Service is entirely at
your own risk.
9.10. That you are aware of the risks involved in using The Service by The Service
user and/or any third party, including damages to privacy and/or confidentiality
and/or safety of information.Therefore,the use of The Service including any
reliance on The Service is entirely at your own responsibility, and you hereby
release SmartNet of liability for any kind of damages, loss and/or material loss,
directly, indirectly or consequential, that will be caused to you or any one on
your behalf or any third party as a result of using The Service.
9.11. To compensate and/or indemnify SmartNet and/or anyone on its behalf for
any kind of damages including loss of profit and/or loss and/or expenses,
including litigation costs and attorney's fees that will be caused to SmartNet as
a result of breaching the Terms.SmartNet keeps its right to defend any action
that will be taken against it for misconducts in connection with the use of The
Service and you are hereby undertaking to co-operate with SmartNet in such
actions as far as you will be required.
Miscellaneous
- This agreement is governed by the law of the state of Israel. Courts
located in Tel Aviv alone have jurisdiction
over all disputes arising out
of or related to this agreement and service.
- Any Failure by SmartNet to exercise promptly any right under the terms
and/or law will not create a continuing
waiver or any expectation of
non-enforcement. |
